Title: Mediation or Not
Question:
I am currently in the process of getting a divorce through mediation. I
was asked by the mediator to "come up with a proposal" to submit to my
wife. I admit I only surfed for a couple of hours, but I am OVERWHELMED
by the amount of information available, almost too much! What I am
looking for is some type of model or template agreement I can follow so
I don't leave out anything important. I would appreciate any
suggestions.
Answer:
I am a strong advocate of mediation which I think is under utilized in our time. As you probably were told, they help you figure out where both of you stand and attempt to get you to reach agreement on key items. Then you can have your own attorney look at the agreement to be sure all things have been covered. Items than can be discussed and agreed upon include child support, child custody, property division, spousal maintenance, payment of health and life insurance, etc. What you need to do is make a list of things you consider important and go back to the mediator prepared to talk.
It feels a lot better to make these decisions yourself without the court having to do it for you.
