Question:

I found your email address on the Divorce Source website. My 12 yr. old son
wants to live with his father. I know my question may be difficult to answer
in a short letter. However, I need to know under what circumstances my ex
could be granted custody. Barring emotional, mental and physical abuse. My
son has reach preteen age and doesn't like his brother, sister or stepfather.
He doesn't like house rules nor the consequences for not obeying them. His
father refuses to discuss the reasons for my sons decision with me and has
hired an attorney to "sue for custody".
Any information or advise you may have would be helpful to me.
Answer:

A judge might listen to your son at this age - and if he is already
causing so much commotion in your household - why would you want to hold
him with you - when he is trying so hard to go with his father.
If you continue to force him to stay with you - consequences on the rest of your family could have a long term effect. Let him go to his father and keep an open door and friendship with him so that if he ever wants to come back - he will.
