Title: Child Support - Fight for Fathers Rights?
Question:
My question would be seeing that either party has primary custody of the
parties daughter and up until the action of the mother I was the primary care
giver watching the child over 50% of the time, making a modest income of
approx.: 15,000 yearly.
During the time I was served to paid child custody the hearing examiner had to
adjourned the hearing several times. Needless to say it took 8 months for a
decision of paying support of 60.00 per week + day care and $210.00 per month
for additional medical insurance.
I was then hit with a large arrearage child support bill and since this time
the judge has order me to pay an additional 100.00 per month.
Now I have made an appeal to the family court in which I lost and since made
an appeal to the supreme court, also I have lost this appeal. I have a choice
to further this appeal however I want to do it for the rights of men that are
not dead beats. I feel that strong about this issue. Their are cases out their
that support my side of this process on which I should have had my child
support modified or back to a new trail or simply at zero.
This decision has an adverse affect on my daughter and is interfering with my
abilities to have a nurturing relationship with her. Also since I now have
another child with my new spouse that is under 2 and this is a hardship and
additionally has an adverse affect on my relationship.
I also am paying 40.00 per week for another child from a previous marriage.
I love my children and want the best for them. I have tried and every thing I
do seem to fall short of making a living and providing for my children. I
cannot even take to a movie, buy a pumpkin for them for Hollowed. Both my
parents and in-laws have help out too much by helping me with the bills and
all.
I'm trying to build a stronger real estate business and since have increase my
income to approx.: 30,000 yearly and hope to make more advances.
My estrange has also turn me into the IRS and now I'm fighting to maintain
what I have. My estrange works for an attorney and just simply if I breath
wrong I'm back in court. ( she is the one that left the relationship) but she
is upset with everything I do.
the parties child is suffering, she has developmental delays and behavior
problems. I had to get turn in to the department of social service because I
try to bring this to her attention. After their investigation found the case
unfounded and seal my file. Then I year later I contacted the school and threw
screening they found the parties child with served delays in speech and
behavior problems.
Is their anything I can do? Should I try to further my appeal for the right of
men or should I try to modified the order or custody order by going for
primary custody?

Answer:
I am totally confused and your facts are not adding up. For example:
$15,000 divide by 52 = 288.46
$30,000 divide by 52 = 576.92
Child #1 = $60 wk x 4 = 240.00
insurance = 210.00
child care = ?.??
payment in areas = 100.00
Child #2 = $40 wk x 4 = 160.00
TOTAL $710.00 a month
I find it extremely interesting that you are "suppose" to be paying $710
when you only bring in $576.92 a month? This doesn't include any money
for you to survive on????????????????
At this point, my recommendation to you is not to worry about making it
better for "mankind" but try to take care of your responsibilities. If
you think you have a good point - you would have already won through the
court systems. The fact that you keep losing should tell you that you
are barking up the wrong tree.
Yes, there are cases out there where fathers are paying way to much - and
yes they have the option to go back to court and get it reduced. But
then there are a lot of parents out there who just don't pay what they
are suppose to...
