Under the common law, grandparents had no duty of support to grandchildren. Some states have passed laws establishing a duty by grandparents to provide child support. Most of these statutes have provisions that the nonpaying parent be under the age of eighteen or is in some way an unemancipated minor, with the additional requirement that the nonpaying parent be living with the grandparent. The basic idea behind these types of statutes is that "someone has to pay to support the child(ren), and itís not going to be the state."
