So long as the arbitrator treats the parties fairly and equitably, he or she is free to follow any rules he or she would like. Sound crazy? It can be, which is why you need to make sure you are hiring a well-trained arbitrator! The arbitrator will usually establish the ground rules at the beginning of the first meeting, so that all parties and their lawyers will know just what is going to happen and what is expected of them.

When hiring an arbitrator it is a good thing to ask for his or her arbitration guidelines. Most arbitrators will have this prepared on paper and may give it to you with a short contract that would be signed if you should decide to obtain their services.
