Doesn’t a separation agreement make divorce more common?

There was some concern that allowing a divorcing or separating couple to negotiate would increase divorce rates, but after years of existence, this does not seem to be the case. Based on that argument, separation agreements were once prohibited in many jurisdictions, based on just that argument, but that is no longer the case in any state.

Most lawyers and judges will admit that separation agreements and the separation process on the whole have lead to more amicable divorces. They create a better situation for the children and allow spouses to move on with his and her life.
