How do judges consider age and health?

If one spouse is in ill health, judges may give that spouse a larger property award. It would be deemed that the spouse with a health condition would need more money to live and would have a lesser earning capacity.

As for age, if the wife is older, for example 55. She may not have the potential to generate a significant salary in the immediate future. She may have given up the opportunity of a career to raise the children. In this case the judge will certainly give this consideration and probably award the older wife more property.
