I can’t afford to pay for the upkeep of such a big house. Can we just sell it?

Yes, you may sell the marital home. Upon the sale, the proceeds will be divided according to the equitable distribution set by the court (or what is agreed upon by you and your spouse). Costs of the sale, any remaining mortgage, commissions, attorneys’ fees, and taxes will be taken out of the proceeds before they are distributed.

The following is a sample clause that would appear in the settlement agreement:

The parties agree that the real estate known as:

1234 Washington Street, Boston, Massachusetts, 18432

shall be listed for sale at market price. Net proceeds of this sale after deduction of all expenses, taxes, liens and mortgages will be divided as follows:
