Is there anything else that may be detrimental about arbitration?

Many people do not like the fact that the arbitrator is not bound by the rules of evidence. On the other hand, many people enjoy this bit of freedom. Of course, the participants to an arbitration are free to determine the extent to which the arbitration will adhere to the rules of evidence by establishing the guidelines prior to the arbitration.

If you and your spouse cannot agree to the guidelines of the arbitration, you should probably move on to the courtroom. It is probably not a wise decision to have an arbitration over the arbitration guidelines.
