New Hampshire Premarital and Prenuptial Agreements

The Uniform Premarital Agreement Act, which was written by the National Conference of Commissioners on Uniform State Law in 1983, encourages the enforcement of prenuptial agreements. The exact UPAA standards differ from state to state just like other divorce laws. The following is the New Hampshire state statutes regarding premarital and prenuptial agreements and how they are considered and enforced by the New Hampshire court.

New Hampshire: N.H. Rev. Stat. Ann § 460:2-a (2007):

Statute authorizes agreements but silent on alimony modification.

460:2-a Antenuptial Agreements. –

A man and woman in contemplation of marriage may enter into a written interspousal contract and the courts of this state shall give the same effect to such contracts entered in other jurisdictions as would the courts of that other jurisdiction. However, no contract otherwise enforceable under this section may contain any term which attempts to abrogate the statutory or common law rights of minor children of the contemplated marriage.
