What if we agree that I should remain in the house until my remarriage?

Again, this is a commonly requested situation and is easily provided for in a separation agreement.

The appropriate wording would be as follows:

The parties agree that the wife shall have sole and exclusive occupancy, use, and possession of the marital residence from the date of the execution of this agreement, until the earliest to occur of:
A) the wife’s death; or
B) the wife’s remarriage as defined in herein in paragraph ____; or
C) the eighteenth birthday of the parties’ surviving child.

The parties agree to place the marital residence on the market for sale at that time and to divide the proceeds of the sale as set forth herein.
