Ok So me and my wife have been seperated for like 5 months and have not filed for divorce yet. She is now a month pregnet and we both know its not mine, she does not want to file custody or child support were just wondering if we will have to wait until the kid is born to get divorce or can we go ahead because we want an open shut case because we just want to be legal to be with other people so please help with any advice..........thank you

There are complications when there is a baby on the way. In many places you can't get a divorce granted, as children born while married, are considered to be the husbands. It would be up to you prove, with DNA evidence that the child isn't yours, and that can't be done until after the birth. You need an attorney immediately.
