My sister just filed a few days ago and it has gotten ugly. Her husband took all the files and photos and "put them in a safe place". He then changed all the passwords and drained the bank account. She lost her temper and hit him and he had her arrested, pressed charges, and let her spend the night in jail. She currently has a restraining order and can't see the kids for 5 days but he has planned to take them out of state for 12 days. She is also worried that he will get a new restraing order and she won't get to see them. What can she do if anything?

>>>>>>>>> Not much . She assaulted her spouse , the legal presumption is that she not recieve primary custody as an " abuser " . Concentrate on dealing with the criminal charges and request visitation with the kids through the courts .

Well sure enough she was served today with a restraining order until 9-11-08. I'm so sad for her but she is owning it. She is eager to do anger management and anything the court tells her to do. Can the order be canceled by him or once it is filed is that it?
