In Oct. 2007 my ex verbally agreed to let me move 1 1/2 hours away. Originally we had a divorce agreement, no lawyers. We agreed upon a new visitation schedule. Our arrangement is that I drop them off to him on Friday's during the day and he meet me half way Sunday nights at a specific time to drop them off. Well my kids will be in a new school next year and cannot be dropped off during the day on Friday's anymore so that will have to change but the problem I am having is that he is always late to drop them off on Sunday's. I have asked him numerous times to be on time but he is still anywhere from 30 min. to 1 1/2 hrs late to drop them off (and my kids have school the next morning!). Am I well within my rights to tell him that when he wants them he is to pick them up and when I want them I will pick them up? Meaning that on Friday's when it is his weekend he will drive here to get them and when it is Sunday and I am to have them come back to me I will drive to his house and pick them up. I dont know what else to do as this has been going on since before I ever moved. I dont know where the law would stand on this if it went to court. Any advice would be really helpful!! Thanks!
I see no problem with that. Why should he care if you would like to come pick them up on Sunday. Seems to me it would be easier for both of you. And the children would get home on time. Try to explain to him it is in the children's best interest to get home earlier. The court will rarely get involved with such trivial matters but will order a visitation schedule if the two of you cannot agree.
