Does anyone know if there is a time frame where the spouse has claim to a pension/401K? I have only been married 3 years.

In most states the spouse can attach your retirement benefits and be entitled to a portion for the 3 yrs. you have been married. It is considered marital property! Yuck!

Is it just a straight 50%? We are trying to work things out on our own and just pay one lawyer to draw up the paperwork and it's her lawyer so I know who's interest he is looking out for...

It's typically 50%, but only what has accrued during the marriage. Anything contributed before is exempt.
