my marriage and divorce is in louisiana (community property state) ...i have a tract of land in mississippi which is not a community property state.. while "happly" married we started to build a home on the land... the home was to be sold for investment purposes...... i obtained an interum construction loan in order to build the house... well we are over budget i am now going through a divorce all construction has stopped..i am giving the keys to the home to back to the bank via dation en payment. if the bank wont accept this they will forclose.....my question is.....Is the loan considered a community property debt even though the property is no?... the bank is located in mississippi and louisiana
