We came over here to Germany and then separated. We don't want to live together, but he's not cooperative about getting a divorce because he needs my health insurance. i've gotten him off my ID card, but can't get a divorce because we no longer live in Virginia and haven't lived in FL for 6 months straight, because I got a job here in Germany. I went back and forth through JAG, lawyers in FL, lawyers in VA and German lawyers. I thought the solution was to get a German divorce, paid a lawyer a lot of money and the judge said no, because I have to support him because he doesn't make enough money and he doesn't have health insurance. So no divorce. According to German law, if we were married over 3 years or so (we were married over 20) I'm always going to be responsible for him. I've got the kids, the job, he's a bum, but I can't get a divorce from him. I don't want to be legally responsible for him any more. VA says we no longer live there, so I can't get a divorce there, FL says I haven't lived there long enough - and won't as long as I've got this good job in Germany, so I can't get a divorce there. Does anyone know how I can get a divorce????? Please help! I've tried JAG, they are no help. Is there a state or country that makes it easier? I'll move if I need to.....

relaxlaughlove, I am assuming you are an american citizen but not exactly sure which state you are a resident of. It doesn't sound like Florida. Anyway, try the nearest Amercian Embassy for help in this legal matter.
Hope this helps.

we lived in VA together for 20 years. I moved to Florida and changed my residency to that state right before I got this job in Germany. VA says since I haven't lived there in 6 months (4 years really) and I gave up my residency there, I can't get a divorce there. FL says since I didn't physically live there for 6 months, I can't get a divorce there. That's my problem. I don't have residency. Who at the embassy would I ask for help? Thanks for your response.

RelaxLaughLove, I would think that if no state was willing to help you that maybe the federal government might be able too (I know, strange concept). I just went to the State Department website and they have some information that might be useful and get you started in the right direction. Here is the website;
http://travel.state.gov/law/info/marriage/marriage_641.html
Anything is possible if you just keep trying. You may be able to write them via email to get your information. I know it can be frustrating at times to get things accomplished in a timely manner but don't get down (2 years and counting for my divorce to become final). Be persistent. Stay strong and do what your username suggests; relax, laugh, and love.
