Married in Nevada 3 years ago. moved to California. 1 year ago. she took off 7 months ago. Only contact is her sister in las vegas. How do I file for divorce if I can't locate her to serve papers. Can I file in Nevada or will it be California. thanks for any help
You have to file in CA as long as you meet the residency requirement of 6 months , you can only file for divorce in the county you live in as long as you've lived there for at least 90 days . You cannot file for divorce until you meet all the residency requirements .
The courts will require you to make a " good faith " effort to locate your spouse before granting a " divorce by publication " .
