child/spousal support question

I filed for child and spousal support with the courts last month and will go for the conference in a few weeks. To give you some background: I have not worked in 6 years to be a homemaker till the children reach grade school. My son is 5 and in Pre-k and my daughter is 8 and in 3rd grade. I do not plan on going back to work till the fall when both kids are in grade school. We are seperated and have been married 10 years. He makes 70k a year. We can't come to terms on the divorce and will probably have to see a master in January 09' ---that will make 2 years since the date of seperation. STBX doesn't currently pay a morgage or rent, or any utilities. Is it likely that I will get temperary spousal support and child support and if so what would the rough numbers look like?

Child support would be in the $1200 range. It will vary slightly with your income, but not much, as it is heavily slanted in the custodial parent's favor. For example, if both your incomes were $70K, it only drops about $200. Alimony may or may not occur. More information is needed on your past work history, and more importantly, what your educational level is. What will your approximate income be, when you go back to work in the fall?

I am 40 years old, I have an AA degree in general studies from 20 years ago. I worked in customer service. I suppose I would get maybe minimum wage now or just above...When I stopped working 6 years ago I was on a restricted schedule due to pregnancy only allowed to work 4 hours a day. I think I made 18,000 that year. Then I stopped working because it would cost me more in childcare then I was bringing home.

Some spousal support is probably merited. The one thing on the edge here is the length of the marriage. 10 years is a magic threshold in many jurisdictions.

You should put together specific a plan and timetable for getting back to work and request a support amount and duration appropriate to help you through that transition.

Are you sure you made $18,000? At 4 hours a day, that comes to $17.30 an hour.
