Hello, my wife and I have been separated for almost 3 years with no contact whatsoever. There is one minor child involved, and she has already filed for divorce, however, will not let it go to court. Is there any simple way to end this? Custody is not an issue for me, but I would like to get on with my life, and having this marriage hanging over my head is not helping matters.

I am in the same situation but I have already filed. He has been MIA for the past year and a half and getting this going has been a nightmare. YOu need to be proactive and since you have no contact, you can file yourself and do it by publication. And why is custody not an issue for you. If you do not have contact with her then you obviously do not have contact with your child. Am I correct?

nope not concerned with custody.


What do you mean do it by publication? Im up for anything, just need to know what to do so I can do it already.

You cannot get a " divorce by publication " if you know where your spouse is .

She wont let it go to court because she's afraid Ill enforce my parental rights. I would tell her I agree to sign over my parental rights to just break free from this entire situation, but I have no idea where she is, no address, no phone number, no anything. If someone could give me a pointer in the right direction on how to do the publication divorce, I'd really appreciate it. Do I need to contact an attorney, or can I file it myself, and if so, where/how do I file?
