My wife left me and our two children approximatly one yr ago. She left us in Phx. AZ and moved back to our hometown in West Virginia. What and when can is child abandonment be considered. She did contact them by phone and came to visit a few times throughout the year but did nothing as far as parent resposiblities.
I filed in arizona so she couldn't take the kids. That was in Feb. I've recently moved back to our hometown also. She left in August, by Sept she has been living with someone also. We're not evan legally separated and just the other not my older son saw them sleeping togather, it was hard on him.
If you are now in WV, take all of your papers and file here. Some states will not recognize other state papers filed. Make sure and cover your and most importantly your children's butts. Good Luck
