OK, this is a bit hard to follow, at least for me. My wife and I have been married three years. We lived in Winter Haven, FL when we married. After two years, we moved to Kennesaw, GA. After a year there, she left me and moved back with her family in Winter Haven, FL. I have moved to NY with my family. Which state does the divorce get filed in? Do I have to be present in the state in order to file in that state? Do I have to be physically present during the court proceedings? I have been unemployed for a rather long duration and meanwhile going to school for a graduate degree, therefore cannot afford to be traveling all over country? Please advise.
She can file for divorce in Florida , you can file in NY if you've lived there for at least 1 year . A simple uncontested divorce ( no kids , property , SS ,etc . )can be accomplished in either state .
