My spouse committed adultery and is now pregnant with that mans child. My spouse admits the child she carries is not mine. I want to divorce her. What should be my next step? My spouse and I have two children. What should my misguided spouse do to get child support from the guy she had an affair with?
As of right now , you are the unborn child's legal father because marriage creates a presumption of paternity . It is unlikely a divorce would be granted until after the birth . You would have to dis-establish paternity and have your STBX sue the biofather for paternity and CS . Although Idaho does have nofault provisions for divorce , there are also fault grounds that can have an effect on any alimony you might have to pay .
