I've been married to my husband for 8 years now. I recently found out he was having an affair. He told me he needed some time to think out his options, meanwhile unknown to me he kept seeing this woman. I have 2 children, 1 together. Here's where it gets tricky. I told my husband I was living to get my head around things (I left the state) The whole entire time I was gone we talked like we would get back together. Then the divorce papers came and I was order to return our son back to the state. Now my husband is fighting for custody of our son. I quit my job before I left and have no family here for support. I want to move out of state. I left my teenage son with family while this all plays out. What do I need to do to get custody of my son and move to another state. My husband knows the law and uses it to his every advantage. What materials can I use in court to show he's an unfit father. I want nothing from this man only custody of my son and his doing what he did through our entire marriage controling my life. He wants me to suffer because I'm ready to move on with my life. SOMEONE HELP ME PLEASE. Any advice would be apperciated.

Indiana is a woman's state. The courts really don't want to take children away from their mothers. If you can prove he was having an affiar that will help your case greatly. However, they usually want the child to stay in the same state as the other parent for visitation rights. Since you are not working you may want to check into legal aid or your welfare office for the 4D program. They will help with getting support for your child. Also, you may want to try to get spousal support.
