hello all.. i have tried to search up some info on this matter but came up with no result. so here is the story. as of now the husband wants to have my name and address to file his own case under adultery committed by the wife after she has already filed her own case. (dont know which.. maybe unrecon diff) . he bluffs about having proof but as far as my understanding he has to catch us in the act. im actually very upset over this matter because her and i are actually very good friends and i had no intention of such acts. what happends to me if he does so and is there any legal matter that i can take upon his false accusation? i kno that if he decides to, i get a letter that my name is mentioned in a lawsuit.. is that all?

thanks

If you perjure yourself in court and he can prove it, you could be facing charges.

Why he is bothering with all of this is really the question. Because in NJ, fault doesn't matter when it comes to division of assets or custody issues.

You will have to get served with the divorce complaint and may get called in by the other party as a witness to the case (you may even get deposed). The other party does not have to "catch you in the act" to prove adultery, they just have to show opportunity and inclination. From my experience, most cases where adultery is a grounds for divorce, the complaint gets amended to irreconcilable differences at the time of the divorce settlement.

I am in a similar situation with telephone calls. I would like to know if "intent to or inclination for adultery" is decided how does that effect the divorce process for the the person being accused?
