We live in Ohio. We were married for 10 years, I'm 41 now and she's 59....WHOOPS! She has never made more than $4000 per year any year of her entire life (and only 3 times has she even broken $4000, most of the years are just zeroes) she just absolutley REFUSES to work! We have no children together. She has signed a separtion agreement detailing no spousal support to her, she agreed to this because I have been paying all expenses (including mortgage) for her for three years while she gets "on her feet." She to this day has not taken a job. She has agreed to take over the mortgage, since it's very small and only has 5 years left on the note, not sure how she's going to do that since she will not work, and to refinance before 1 year, or we sell it. Otherwise, she gets a house and all possesions unto basically paid for, and I get my freedo(o)m?
Some questions: Does the sepatation agreement have any validity until finalized by the judge?
Can she "change her mind" during this period up to the finalization by the judge?
Do the courts typically accept an agreement such as this?
Based on her situation, can she make a case for permanent spousal support?
I know I've posed alot of questions, but any input to these questions would be greatly appreciated.
