hello i had a few questions on no-fault divorces in Pennsylvania. how long do they take to get processed normally, if both parties agree? Also can you still get a no-fault divorce if one party doesn't agree to sign for it? If so how long does that take and what are the laws on that? Those are all the questions i have for now thanks in advance for answers.
Part of the meaning of no-fault divorce is that the divorce will be executed over the objections of the other party. There's typically a waiting period between filing for divorce and it being granted. In my state (CO) I beleive the waiting period is 60 days. New York has the longest waiting period at 1 year. I'm not sure what the deal is in PA.
I am in PA & if both parties agree to the divorce it can be finalized after a 90 day waiting period. However, if 1 party contests it the waiting period is TWO YEARS! So I guess that makes PA the state w/the longest waiting period. I speak from personal experience - I left 3/31/04, filed for divorce in early 5/04 & we couldn't proceed until we'd been separated 2yrs (not 2yrs from date filed but from date of separation). And it's still not over, my stbx has been dragging it out as long as possible, at this point I'm waiting on the appraiser to complete the appraisal on the personal property (it's been a month today since he finished looking at everything - I called him 10days ago & he said he had 8 appraisals to complete, not sure if I should get my lawyer involved - I'm afraid that might p*ss the appraiser off plus it just means more $$ for the atty). So if you want a quick divorce & the other spouse is not agreeable you can have a long wait in PA (long & expensive wait as I have to pay him spousal support at least until the divorce is final - may switch to alimony then, who knows).
