There is a rebuttable presumption of paternity if the parents were married at the time of birth or if the presumptive father signed the birth certificate . If an Acknowledgement of Paternity was signed he is the legal father whether or not he is the biological father . As there is no child support order in place , he can try to contest paternity unless he unknowingly also signed an AOP with the birth certificate .
