I just went through a divorce and a persons military retirement pension is considered a marital assest. Depending on the state in which you last resided in together, depends on what you will get. Most states divide marital assests 50/50, meaning you both get 50% of what ever assets you have. The military pension is then calculated by a formula. Years of marriage divided by years of time served in the military times 50 percent. Example: 154 months of marriage times 50 percent divided by 240 months (time in military) = 32% Be very careful and make sure you get an attorney that is very familiar with Military language.
