In NJ, Tax returns are a standard part of the disclosure step before property can be divided. If they aren't supplied by the parties, you can be held in contempt of court. Maybe the IRS can't provide you his returns, but I believe he can be subpoenaed to do so by the court. So, he would provide them. Not the IRS.
