Can't get birth certificate for my daughter

Help! I have been trying to finalize my divorce for 3 years with no luck, even though I have turned in all documents to my attorney. But here's the real problem for me, I had a child with my boyfriend and when I applied for the baby's birth certificate I got a letter instead, saying that either my husband's name goes on the birth certificate or I don't get one at all! So I can't get a birth certificate or a social security card until this divorce is resolved. Is there any way around this? I can't even file my taxes correctly either! Anyone have any idea of what I could do? What are Hawaii laws on this?

You were married at the time of birth , that means your husband is legally the child's father . Add your husband's name to the BC , have him dis-establish paternity , the bio-father establish paternity . You can then petition the courts to have the child's last name changed and the bio-father added to the BC .
