help regarding laws on moving abroad
|
|
hi all im kinda new here ill explain as shortly as i can. I am a dad of 2 children aged 3 and 5, My wife, there mother, left the family home in michigan after being married for nearly 4 yrs to live with another man in texas over a year ago. I would like a divorce due to the fact since leaving she has been with several men and women and has not been in contact with her children. The last time she called was in october 2007 when she was drunk and apparently missed me and wanted to try again she didnt even mention the kids . I later found out that day she was moving to florida to be with another guy. She has not denied she is not a good mother she loved it when they were babies and refused to do anything for them whe they grew older, her words not mine. I have lost my job due to no family support and have just today been given a 30 day notice due to unpaid rent. I have struggled to find work and poay of all the bills she left me with before she moved out she had it all planned she sent an email stating she was leaving to a friend a week before she left.
I have been speaking to a wonderful women in england who has 2 children of her own whom she brings up alone and have discussed the possibility of moving the relationship forward ie perhaps getting mariied once i am divorced and have settled debts. I would like to move to england i have been offered a job there with a house but am unsure as to whether i can one whilst i am still married and 2 after im divorced. I know she will not even turn up to the divorce hearing and probably wont contest regarding the children she just dont care she missed there bdays thanksgiving and christmas they were very disappointed. Can anyone offer me any advice on this she neglected the children and have some reports i could use as evidence but do i need her permission? I would of course still alow her to see them i would be returning to the state on regualar intervals and would never cut her from there lifes i just dont know what to do no more. The bills have piled up my gas has been cut off im assuming i will be eveicted and just have no place to turn no more any advice is much appreiciated
thankyou

Things will be simpler if you have sole legal custody , a distinct chance if she's unwilling to contest it . Even with sole legal you still need her or a judge's permission to relocate out of state .

Thankyou very much for your reply i was afraid i'd need her permission i dont think she would contest as she has basically cut herself off from our childrens lives and only seems to remember she is a mother when her latest boyfriend has ended things. I feel sorry for my children i want to give them the best possible start and moving abroad will help me get a good qualification to be able to return to that states where maybe she may be ready to be a mum again and i can provide better for my family. I think i will have to seek legal advice on this if i am able to find a lawyer who can assist me on a very small finacial frame :(
