Residency requirement questions
|
|
My STBX and I lived in Illinois, and I've recently moved home to MO. The laws in MO are easier to navigate, so we'd like to file for divorce here (it's amicable). I know that the residency requirement for filing is 90 days, what I'm wondering is can we file for a legal separation in Illinois, and THEN file for divorce in MO? Or do they both have to be done in the same state?

The first filing will generally establish jurisdiction. To avoid complication, you want to handle it all in one courthouse.

Re: Residency requirement questions

Does anyone know how exactly they verify residency? I've been here 30 days THIS time, but I've spent many weeks here throughout the last year, and my therapist mentioned that she thought that would count towards my 90 days. If so, how I do I prove that?
