What would you do? I'm in a crunch because stbx isn't paying his truck payments. We both are signers on the loan. Bank keeps calling me asking if I can contact him. Get him to pay. yadda, yadda, yadda. I email him. I text him. No response. He never answers his phone when creditors call, and his voice mailbox is eternally full so they can't leave messages. I even went so far as to submit a proposal to my lawyer that if I pay the truck off, stbx will lose all rights to my 401K and alimony. However, these types of agreements take time to get into place, and the bank needs to know like tomorrow what we're planning to do. Do I let the truck get repossessed and get that blemish on my credit? (I was basically able to extract myself from everything else that was joint or have responsibility for the payments - which I always make) We'll need to be refinancing houses and things after this divorce and I'm worried a repossession will make it much harder for me, and result in higher interest rates. Anyone else go through this? |

Do you need the truck? If you pay for it you better be the one getting it. Can you work anything out with the lender, like some of the payments until your lawer can do something? You need to prepair a file for it does go back. Things like letters to the lender, stbx were you tried to work it out. It will help later to show you tried. Credit card companies will not care but getting a loan on a car or house it could help depending on the lender. Even some smaller banks will look at it. |
