The largest awards are to housewives from long marriages (such as yours) who argue they are too old to get required training and make a go of it in the workplace. The age of you and your spouse and your incomes are crucial pieces of missing information towards assesing the reasonableness of her request. As far as assets and debts, overall you should be splitting those 50-50. You'll need to pay half of her credit card debt but not all of it. She can ask for half your pension. If she has a pension, you can ask for half of her's. Reading betweeen the lines on this one it sounds like you were married to a spendthrift who has hired an agressive lawyer and they're shooting the moon on their first settlement offer. If you and your lawyer continue to take a soft stand, you'll get eaten. |

We will need more information to give better advice but I think kgrow summed it up pretty nice for the lack of information given. My opinion with the info at hand is that it seems unreasonable. She is entitled to 50/50 of the benes she is also entitled to 50/50 of the deficit. |

Hello, How it worked for myself was my lawyer took my income(which I'm on permanent disability) but had worked for 15 years until I was injured, and my "X's" income and combined them and split it 50/50, same with our retiremenets. Our divorce was different because we never seperated until our home was sold and then we had to split all of our debt 50/50. I was divorced in Vermont. Sue |
