Child support after spouse remarries
|
|
Just curious what the Iowa laws are about continuing child support payments when a spouse receiving the support remarries. Is the support based on need or is the person paying the child support stuck with the court recommended amount (at the time of the divorce) until the kids are of age?

The new spouses income is not part of the equation, so it continues.

Thanks for the reply. Maybe someone (you) can answer another question? I've heard that if the payer of child support has the kids a certain percentage of nights above what the court set (at the time of the divorce) then the child support can be adjusted. Example: My ex has primary custody so she has the kids 2/3rds I have them 1/3. I give her roughly 1/3 of my income to make up for the extra time she has them. If I have the kids 1/2 time is that reason enough for the court to adjust the child support payment.
