She's charging over $1,000 per month!

My wife has been begging for a divorce for at least 5 years. Her mental cruelty was getting to be too much to bear but I stuck it out for the kids. My wife was coached well on this I am finding out. She would tell me that I would have to get 2 jobs to support her and she didn't have to work. Well, the courts are telling her that she does have to go back to work, which is the only thing going my way. The questions I have are: I moved out last July, my wife has credit cards in her name only and is spending over $1,000 per month. My lawyer is telling me that I am responsible for this debt. I cannot stop her and she is having a field day. Is there anything I can do? She does work 30 hours per week, and I also give her $1,900 per month so she does have sufficient money, but as long as I am paying, it is CHARGE IT! The next question I have is that when we filed the papers over a year ago, my lawyer told me that all finances were frozen, all debt and assets would be devided at those amounts. I have since then put $10K in my 401K, now my lawyer is telling me that she gets half of that. So my dilema is that am I getting bad information from my lawyer? According to him, I lost an additional $11,000 to my wife in this last year alone ($5K-401K & $6K-credit). Does anyone have any information or help for me?

Exactly what papers did you file...when I got divorced my X took all his credit cards with their debt and I took mine...he took his car with his payment and I took mine...if it is a joint accoung then you are both responsible but if they are in her name and only her name and she has been charging the whole time you have been gone a good lawyer will get her to be accountable for them..yes if you were told your assets were frozen and then you added money the additional money should be yours and yours alone...your lawyer sounds like he doesn't know squat....

The papers that we signed were for "temporary orders". The papers included temporary support and temporary visitation only. When we filed these papers and had to do financial disclosure, that is when I found out that my wife had 4 credit cards in her name only, and 3 of them were maxed out. At that time I told my lawyer that I had no knowledge of these and felt I shouldn't be responsible for them, and he agreed and said I wouldn't be responsible. He also told me that the savings were frozen at that point also. The trouble is, since then, that lawyer retired and gave the case over to another lawyer in his firm. The new lawyer says that "he" made no such promises and that I am responsible for her new debt, and she does get half of the new savings. I know what is right, and I know what people say, but what is the law on these matters. Is it cut and dry, or is it grey?

The only thing that is cut and dry here is that you need to get a new attorney! Do not hesitate. Do your research and get a good one! In my divorce I was not liable for HER credit cards. Good luck!

Thanks for all your replies, I would love to take my CC debt and my wife take hers. the problem with that is, my CC debt is $0, and hers is $20K. I would also like to get another lawyer but if the case makes it to 6/25/06 that make 10 years of marriage and I was told that she could get half of my socail security. I do not think I have time to get a new lawyer and have them complete the case in that time frame. Once again, another decent husband getting screwed by the system.
