Spousal support Help
|
|
i have been married for 9 years. My wife was working as a preschool teacher for the first 4 years of our marriage. She has her bachelors degree in early childhood and elementary education. For the past 2 years I have been home with a perminent disability. My income is from private disability insurance. I have no problems with child support. But is she entitled to spousal support. We have both been home even if I am disabled. I am able to take care of the kids and have done so when she went out of town to visit friends for 4 days here and there. Any help will be appreciated.

Spousal support is very unlikely if she makes more than you . Are you asking for support ?

I bring in 2900 a month from Veterans disability as well as 3600 a month for long term disability.. So my monthly income is 6500.00 even if its disability.. She chooses not to work even though she has a bachelors degree. I figure I'll pay around 1200 per month for child support. She thinks she can get 1100 in spousal support.. I dont understand how she can get this when she can work but chooses not to. again we have both been home the past two years..

Any reason you aren't doing shared custody? It appears you may be co-parenting the child. How old is your wife? What year did she graduate with her degree? Has she ever taught before? Is her teaching license still current? How long have you been married? All these need to be answered first. Are you familier with APA in PA? If not, look it up.

I am rated as total and perminant disabled at 100 Percent with the VA. SHe worked as a teacher in early childhood ed 5 years ago. Her license is still active. To be honest, I dont have the energy due to disability to co parent. Believe me, I wish I did. I also have my son from my first marriage. I have primary custody of him. he is 16. Here is something new. My wife Stated last night that she could force the sale of the house. It is in both of our names and while she can and will move in with her parents, I have no where else to go. Can she force me out of the house? I hate that this is turning ugly.

She can only force the sale of the house if neither of you can afford to pay for it on your own. If you can afford it, you'd have to buy out her share of the equity and then you could stay. She cannot kick you out and sell it if you agree to buy her out.

we just refinanced 6 months ago so we are at 80% LTV. there is no usable equity in the house and I dont have sufficient credit to get a loan for even a few bucks. I have enough to pay the mortgage and the bills. I have enough to pay our mutual debt. But I cant give her any lump sum of cash. that would force me to sell the house and Its not just me who lives here. I have a 16 year old son and a 19 yo son who is in his second year of college. The 4 and 2 year old are from this current marriage disaster. So If I get kicked out. so do the 2 boys that are living with me from another marriage that I have custody of... Help
