House bought after divorce filing

Hi Guys
My spouse filed for divorce in '04, we got back together shortly thereafter and bought a house in '05 we separated in '07 and her lawyer is using the '04 date for the divorce. How is the house to be divided being bought after the fact? Should it be sold before any divorce proceedings?
