divorce proceedings

My husband filed for divorce about 3 1/2 months ago. We are still trying to get the custody issue resolved, but I want to start the actual divorce proceedings. He hasn't started any type of post-nuptial agreements. He asked me if I talked to my lawyer about divorce. Since he filed, shouldn't he be the one to initiate the proceedings? I don't even think he wants a divorce. He only filed to get me to beg him to take me back and now that I haven't he doesn't know what to do. I live in PA...can anyone give me some advice? Thanks...

If he filed for divorce and you have been served, the proceedings have already been initiated and you need to answer. Or he could get a default judgement.

Get an attorney to help you with this.

Well, just from this information, I would say figure out what it is you need/want out of this relationship, THEN, talk to him about it and be willing to hear out what HE wants/needs. I dont know details of your relationship. Maybe theres more, but if a relationship is salvageable and theres two people with feelings left for each other, anything can be worked out if both are willing to give and take. Unless either one of you have already emotionally checked out, theres cheating or abuse I wouldnt suggest a divorce right away.

We all deal differently with stress or frustrations of knowing how life is suppose to pan out. Its not right to up and leave your family, but theres always two sides. I say that meaning theres always things to work on on both sides. Not, that both sides are guilty.

Just suggestions. There is a difference, as stated above, in "starting the divorce proceedings", and being served. More details would help.

You should have been served by now. Same thing happened to me. I counter suited(if that's a word).... because I was never served and I wanted to get the ball rolling and finished it off. I did. I had to file and sue him and then only then did we get a court date. We didn't agree on anything and this dragged the process. Also, he filed for more time... 3X. Guess he was trying to see if I would take him back. Didn't work. He didn't think I could go thru with it. I struggled with everything, but I managed. I was blessed..... he partied and thought the grass was greener on the other side. He was wrong.

If your situation is one that you think has a chance. Try to make it work. Seek counceling. I don't recommend divorce for anyone. Only you know your situation no one can judge you. I had it bad..... verbal and physical abuse, drugs, cheating,me paying all the bills and him still living there for years. I didn't have much to save. I only stayed cuz of the kids. I sought therapy for me and the kids. I invited X.... but he wouldn't go at the time. Try just try if you think its worth saving.

I filed then she did nothing, or rather her atty didnt. She had no clue what to do. So i sat back and waited for her atty then got fed up. I wanted them to tell me what she wanted from me.

So i met with my atty and gave her a list of how i wanted things to go and i'm sure my wife disagrees but i need to 'start the fight' because we are both tired of waiting.

She did meet with her atty today but i wont know the results of that for a while
