Just starting--custody issues

11 year marriage. 9 year old daughter. I filed for divorce in January. We are still living together as he refuses to move out and I cannot afford to move out until there is a settlement.

I did 80% of the childcare in raising our daughter (at least). He was out of town frequently and rarely home on weekends.

Now he is saying he wants 50/50 for the joint custody arrangement. I have asked for 80/20 (80 for me).

I'm trying to get a feel for what experience people have had in WV with custody battles? Should I just give up because the judge is likely to go with him, or should I fight for the 80%--whcih I strongly believe will be best for her.

We both work full time, she has after school daycare.

I would never settle for 50/50. Most people that ask for that is only thinking of child support, etc.

That can be true, but it goes for BOTH parties!

My husband agreed to a divorce at one point {only a ploy to get me excited} asking for 50/50. I wouldn't agree. He has a drinking problem and is Bi-Polar. However even though he totally destroyed our marriage, he wants me to be responsible for 50% of dental bills, etc. I'm not responsible to breaking up our family, and I refuse to give him 50/50. Right now I'm paying 100%. But at least he is not able to do anything to destroy the security my daughter has.
Since we have not been to court and has not been told to pay he doesn't offer 10% of her upkeep. Real loser.

I would never give up. It sounds like you are doing everything you can for you daughter. The judge will look at who is her main caretaker and the emotional state of your daughter. You need to keep that special bond between you and her, the judge always considers the childs best interest.
