Divorcing wife with alzheimer's

My in-laws have been married for 25 years, but my mom in-law has been in the middle stages of alzheimer's for about 3 years. This past year, my father in-law has become romantically involved with another woman. Today, my mother in-law was served with divorce papers. She cannot physically speak and cannot defend herself. Is this legal? What can my husband and myself do?

Georgia has a nofault option for divorce so he can divorce her . Due to her condition and the length of their marriage he will most likely have to pay permanant spousal support . You really need to consult with an attorney . It is also possible that the courts will compel him to pay her legal fees .

You might consider having your MIL countersue for divorce on the grounds of adultery as it may have some effect on the eventual property settlement .
