My husband and I are getting a divorce and I having been planning a move within the same state (Fl) he has gone to an attorney to stop me from doing so, I was just wondering if that was possible. I am obtaining an attorney but in the meantime I know in the long wrong I can't be made to stay in the same city just the same state, but is there papers that can be filed to keep me in the same city before the divorce is finalized. I haven't been served yet so do I continue my moving plans or will that look bad some how? Please help
He will have to file to stop you. I don't think it will look bad as long as you allow your stbx access to the kids and help to facilitate that access (meeting half way). He very well may try to stop you, and if he does you will have to have good reason for the move. Good luck.
Bad idea to move while the divorce is still pending . Florida recently adopted a 100 mile rule for move aways and that's after custody is determined . If custody is contested your STBX may be favored based on the child(rens) established living pattern including school , friends , home, etc.
