I have children with my ex, and he wont give them to me. We were not married. He signed the birth certificates. Any suggestions? Thanks Im a wonderful mother, but going crazy without my two little ones. His parents watch them all the time. What can I do?

You can have a custody battle. You don't have to be married to do so you just have to be parents.

How did he GET them in the first place? It's not like he has the right to have them unless there's been a paternity & custody case filed.

Sounds seriously like you need a lawyer for this one. However this happened, it's going to be a mess to straighten out. Your first act will be to ask for a return of custody until there's a formal determination of paternity and custody.

Yes, my attorney asked for immediate return of my children, and that was granted. I do have my children with me now. We had to go back to court in regards to this. My attorney spoke with my ex boyfriend, and told him I would agree with every other week end visits, and one night per week over night visits. Also 500.00 child support per month. He thought 500.00 was to much money. My attorney had already informed me I could get more money, but I said NO, he has to make a living also. We are going to mediation soon. I have no clue what to expect at mediation. My attorney will be with me. Im trying to be fair about all of this. Yes, I did defend myself when his father and ex boyfriend grabbed me, shoved me down, grabbed my arm which has bruises on it. I didnt lie to the police when they asked if I hit him. Yes, I was defending myself. I have never had a battery charge and didnt lie to them. My ex has had a battery charge prior to this but not from me. I just wish things would work out for the sake of our children. I did show the Judge my bruises and had pictures of bruises with the newspaper dated behind them. My ex told this last judge he wanted to drop all charges against me. She told him he had to file with another court. So Im feeling much better now. Thanks for the replies.
