My ex is trying to lower his child support. He had a $40,000 a year job which he lost for fratenizing with an employee. He then lost his 2nd job because he was drunk on the job 3 times. He now is on his 5th job in 3 yrs. He has not paid child support consistantly in 2 years in which we have gone back to court for back child support 3 times. His mom pays all the back child support up to date. He also had 2 vehicles repoed, his house foreclosed on and he was still behind on child support. I do not know where his money was going.
At 33 years of age, he and his wife now live with his mother. He has no living expenses. He is currently behind on child support again after our court appearance on May 1st for back child support. He also owes 51% of the children's medical bills. He currently owes me $380 for that as well.
I have a stable job and a stable home.

I guess my question is...Can he really get it lowered being he has lost jobs because of him fratenizing with other employees and his alcohol use??? IT would be different if he got laid off, but he has been fired from 5 jobs in 2 yrs. He has brought this all on himself. He had a great job making great money for 5 years, then all of that happened...meaning he can't keep a job because he is an alcoholic.

Yes it can get lowered-but he has to file the papers with the court system and that will take some time. He will have to prove that he is not able to continue to provide the amount of cs he has been. But if he goes to court for the non payment of child support-he will go to jail. In SC every 90 days the system generates delinquent notices-you should receive a copy. He will be served a copy and have to appear before the judge. You can be present for his appearance and have your say. I know this because I know someone who has been through this.
