I have been seperated from my husband for 2 years and am in the process of beginning a divorce. However, I am preegnant with my boyfriends baby. I was told by a family friend that in Texas you will not be allowed to get a divorce in this situation. True or False?
You can file but the divorce will not be finalized until all issues of paternity are adjudicated . The problem is your STBX husband is presumed to be the father of the child you are carrying if " he is married to the mother of the child and the child is born before the 301st day after the date the marriage is terminated by death, annulment, declaration of invalidity, or divorce " .

How far along are you , and who all knows that you are pregnant ? If no one else knows and it is an uncontested divorce . You could move the divorce along really quick . Get divorced and not say anything at all . If no one knows . Who can complain ? have the bio Dad sign paternity papers and be done with the whole thing .
