Greetings I am helping a friend research a problem that she is in. She and her husband agreed to make a trial seperation where she would take her kids to another state away from florida.
There were some major problems recently where she decided that she just wanted to file papers. She was planning on leaving for two months on this seperation which he approved of. Now he is telling her 'If you are going to do this to me, i am NOT letting you take our kids or any of our cars out of the state'
in effect, he is trying to trap her there when she desperately is being emotionally abused by him and has been for some time.
I have been told that before a divorce, he cant stop her from leaving with the kids, but that she would still need to file papers and probably end up returning to finish hashing out the problems. Is this true?
I myself had a divorce in a different state where I found out that my wife could take my child anywhere she wanted without my ability to do anything about it. So is this true for florida?
thanks so much for any help, she is feeling completely helpless and trapped. Johnny
She has absolutely no intention of not letting him see the kids, and he knows exactly where they will be. She is not trying to hurt the family by taking the kids away from the dad.
So it sounds like she isnt doing anything illegal then from what you are saying
