My husband of 27 years has suddenly decided he wants me out of the house before he gets home from work today. I have stayed at home most of our married life. I have no job or money and would have to go live with one of my children. EEK! The kids are grown and I had surgery last week. If I leave, do I give up any of my rights as far as distribution of assets or should I stay put?
You do not give up any legal rights to marital assets by leaving. You do need file for divorce to maintain control of those assets. That holds true regardless of who stays in the marital home.
Thanks for the jolt of courage! I did not leave and I did tell him to go F*** himself. It's now down to my side of the house and his side of the house. This is more damn fun than eating bugs...HA!
