My stbx was awarded 600.00 a month for six months temp.maintaince payments. I call it "bloodmoney" the way it was awarded (which I dont want to get into) is being reherd in front of the judge soon. My atty told me if we could prove cohabitation with her we can get this dismissed. Several of my friends have been getting pictures of his truck setting at the stbx's house all hours of the nite and early morning. She has also took our camping trailer and had it hooked up permantly to a sewer hookup and water ran to it. Apparently thats where the boyfriend is staying. I took pictures of the trailer and how it was set up today then called my atty. He said keep taking the pictures and get the plates on the van and truck. If he is living in the back yard of her house in my trailer can we still nail her to the wall as we plain to?? I'm sure he spends more time in her house than my trailer.
This is a violation of the city ordanence along with my insurance on the trailer on how it's being used. Any thoughts??

I would also try and grab their garbage. See who's name is on the bills. See if he is getting mail there. My friend, the paralegal told me this.

You might want to check on the eviction laws, though. You might find that, notwithstanding the ordinance violations, you still cannot make him move without a formal eviction, and if he pleads a pauper's oath--that he cannot afford to defend himself against this--he could stay there for much longer. You may also have to prove that you were not responsible for the code violation, and may find you are in less overall trouble if you just move him into the house!

I know you are angry-but is she doing all the 'maintenance' around the house. Is it for sale. Does she have to keep it up to par so you can profit from it? This is coming from someone who is maintaining the property and jumping through hoops to get it sold. You can try to get it in your decree that as long as she lives in the house and you are paying her maintenance she cannot have anyone else living there.

Is the camping trailer in your settlement-it can either be sold and you can split the money or you can buy her out or she can buy you out.

I'd pay it. You got off lightly. You're lawyer will bleed $3600 out of you much more quickly than your ex. I'd not invest more energy in snooping. It's unlikely to get you anything but more bitterness.

"together" only matters in your head, not in court. What matters in court, for the purposes of them deciding whether or not she deserves alimony, for example, is the number of years actually MARRIED.

But you had a tough situation and I'm glad it worked. Tell me, did your lawyer say a word about what I suggested (how she was taking your support and allowing her parramour to live rent-free off your back?) or was it enough to simply have the photos & proof of her infidelity? If so, it would be the first time I'd heard of straight infidelity being used to terminate alimony... since decades ago. Usually it has to be infidelity PLUS something. So I'm very curious!

she went in to "meltdown" when she saw the pictures and knew she was had. She admited he was living there. Asked if he was paying rent,etc the answer was no.Very short and sweet hearing 15 min max.

Ah, not straight infidelity, they DID establish that the lover was not paying rent... guess she had to tell the truth once she was caught, huh? They'd not have asked about the rent if it was not an element of this issue. Yippee! You must have loved your lawyer for fixing this so easy, and he must have loved you for getting all the evidence together for him... good team!
