My husband and I have been married for 30 years and have raised 5 children, who are now independent. My husband has been having an affair with Mr. Boston (vodka). He still works, and makes $40,000 - $45,000/year. I just completed my bachelor's degree in Elementary Education, last year, but haven't been hired in a full-time position, yet. I have been substitute teaching and tutoring during this past year, but don't have a steady income, health insurance, or benefits. My health insurance is through my husband. During our marriage, I was the primary child-care giver, and worked part-time for the past 16 years as a waitress. I consulted with a lawyer, and he told me that my husband doesn't make enough money to pay me any alimony. Is this true? It will take me at least 5 years to catch up to my husband's level of earning, WHEN I get a full-time teaching position, and who knows how long that will take? Also, I have $25,000 in student loans to pay back, some of which was borrowed for living expenses, to enable me to go to school and work less hours. Can anyone tell me if he will have to pay me alimony, and how much? Thanks!

I went to my attorney last week, and she told me that in Norfolk county I am entitled to alimony. The way the alimony works is whatever your income is, they deduct that amount from his income and what is left over is split between the 2 of you. Now you will have equal pay. Also because you have been married for more that 20 years, you get it for life. Just be careful if you wind up making more than him, he could turn around and do it to you. I am not sure about the part of him not making enough money. Good Luck!! If you want my attorneys name, just let me know.

Thank-you very much for your helpful response! It makes me think that I should get a different lawyer, or at least a second opinion! I WOULD like your lawyer's name, even though I am in Worcester county.

Alimony is awarded mainly for 2 reasons. One, if you stayed at home, and had little earning potential, or two, rehabilitive alimony awarded to prepare you for a job. Had you not gone to school, and continued to work very little, you would have been entitled to substancial alimony. But, I believe you won't get it now. Also, are you aware, that if you take a position where at least 30% of the students are from low income families, that you can get your student loan deferred for 5 years, and also up to $17,500 of it paid by uncle sam?
